OFFICE MEMORANDUM

Subject:- Payment on account of discontinued allowances - regarding.

The undersigned is directed to inform that the recommendations of the 7th CPC on allowances have been accepted by the Government with 34 modifications. Resolution in this regard has been published on 6th July, 2017.

2. In this regard, attention is drawn to Para 8.2.5 of the Report of the 7th CPC wherein it has been mentioned that any allowance, not mentioned in the Report (and hence not reported to the Commission), shall cease to exist immediately. In case there is any demand or requirement for continuation of an existing allowance which has not been deliberated upon or covered in this report, it should be re-notified. by the Ministry concerned after obtaining due approval of Ministry of Finance and should be put in the public domain.

3. As the recommendations of the 7th CPC on allowances have come into effect from 1st July, 2017, disbursement of all existing allowances which have not been specifically recommended for continuation in terms of the Resolution dated 6th July, 2017 shall be discontinued from the salary of the month of July, 2017.

4. In view of the nature of the Allowances specific to Ministry of External Affairs, these allowances were not covered by the 7th Central Pay Commission, Hence this order will not be applicable to allowances specific to Ministry of External Affairs.

5. It shall be the responsibility of the Heads of the Department to ensure that no bills relating to disbursement in respect of such allowances is drawn by the Head of Office/Drawing Disbursing Officers under their purview/jurisdiction. Pay and Accounts Officers shall ensure that no payment is effected if any such bill relating to the disbursement of the discontinued allowances is submitted to them. If such bills are received, they should be returned to the DDO and intimation thereof shall also be given to the Head of the Department and the Chief Controller of Accounts.

Air Travel is allowed for Central Government employees those who are in Level 6


TA Rules in 7th CPC: Air Travel is Allowed for Central Government Employees from Level 6 and Above

Now the Air Travel is allowed for Central Government employees those who are in Level 6 (Pre Revised Rs.4200 Grade Pay) and above. It is Good News for those who are in Level 6 to 8, as the Travel entitlement for them so far is AC II by Train only. Now they are entitled to Travel By Air in Economy Class.

The Central Government published Gazette Notification for 7th CPC Allowances on 6th July 2017. The 7th CPC has recommended that 53 allowances be abolished and 37 be subsumed in an existing or a newly proposed allowances. But the Government has decided to retain 12 Allowances from that 53 Allowances and allowed 3 Allowances to continue as separate allowance from these 37 Allowances recommended to be subsumed. Finally the Committee on Allowances and ECoS after the discussion with stakeholders, recommended to Modify 34 Allowances

The 7th CPC has recommended that Travelling Allowances can be continued without any changes. But the Government has decided to extend the Air Travel Entitlement to Govt Servants those who are in Level As per the Gazette Notification issued by Government of India, the Travelling allowance is rationalised to enable the Central Staffs from Level 6 to 8 to Travel by Air . The Official concerned clarified that, this Modified Travel Entitlement will be extended to LTC also.

New Delhi: After long wait, the 7th Pay Commission award has been fully implemented including allowances, which has been implemented from July 1, it has increased new hopes among the central government employees that their allowances has been hiked.

The Union Cabinet cleared the recommendations of 7th Pay Commission in respect of the hike in basic pay and pension on June 29 and government notified higher allowances on July 7, 2017 for its 4.8 million employees and 5.2 million pensioners, in a bid to ease the inflationary pressure.

"Allowances contribute 63 percent in the pay hike recommendation. The allowances which the commission proposed is very substantial. So, the central government employees now not only get 14.28 per cent hike in pay but also to get new allowances, which providing for full compensation to the central government employees," a top Finance Ministry's official told.

Government jobs in India have been less rewarding in terms of pay and allowances. Apart from a sense of job security and perceived power, most of the employees have to struggle to make ends meet with the cost of living going up every year.

The central government employees are seeing inflation catch up with their pay rises as the cost of living rises faster despite of government figure.

With the current basic pay hike and steep inflation, it is not possible for central government employees to make ends meet. It is also impossible to sustain with their current basic pay without hike in allowances. Inflation has climbed steadily over the past few years, which the new allowances will help to compensate.

Accordingly, the new allowances will hopefully attract central government employees to live with dignity and the quality of service delivery in central government offices is expected to improve which will in turn contribute to higher productivity and growth for the nation.

Prasadam supplied by religious places like temples, mosques, churches, gurudwaras, dargahs, etc. attracts Nil CGST and SGST or IGST, as the case may be.

There are media reports suggesting that GST applies on free food supplied in anna kshetras run by religious institutions. This is completely untrue. No GST is applicable on such food supplied free.
Further, prasadam supplied by religious places like temples, mosques, churches, gurudwaras, dargahs, etc. attracts Nil CGST and SGST or IGST, as the case may be.

However, some of the inputs and input services required for making prasadam would be subject to GST. These include sugar, vegetable edible oils, ghee, butter, service for transportation of these goods etc. Most of these inputs or input services have multiple uses. Under GST regime, it is difficult to prescribe a separate rate of tax for sugar, etc. when supplied for a particular purpose.

Further, GST being a multi-stage tax, end use based exemptions or concessions are difficult to administer. Therefore, GST does not envisage end use based exemptions. It would, therefore, not be desirable to provide end use based exemption for inputs or input services for making prasadam or food for free distribution by religious institutions.

With reference to the 6th CPC orders issued vide letter number 21(2)/2008-E.II (B) dated 28th August 2008 and7th CPC orders issued vide letter number No 21/5/2017-E(B) dated: 7th July 2017 issued by the Ministry of Finance, the Department of Expenditure. A analysis of comparison of the transport allowances of 6th CPC and 7th CPC was made, it is found that the Employees those who were in 1800 GP and 1900 GP as per 6th CPC and pay in the pay band equivalent to Rs.7440 and above are losing considerable amount on switching over to 7th CPC transport allowances , Hence the issue may please be taken up at the earliest. A study is made and computed as below.

The issue of transport allowances for field officials should be taken up , presently the field officials who are proceeding on tour on official work are denied the transport allowances if they are absent for whole month from CHQ , should also be provided with transport allowances as there are performing the Government duty.

Subject: Grant of eligibility to the Defence civilian employees for the General Pool Residential Accommodation (GPRA) allotted by the Directorate of Estates Representation from BPMS

The undersigned is to refer to Ministry of Urban Development's OM No. 12033/4/67-Pol.II dated 3rd, October, 1969 on the subject - "Eligibility of the staff of Central Government Office for allotment of residential accommodation from the General Pool-Criteria regarding' and to say that a number of defence civilian employees working in many Defence establishments located in Delhi/New Delhi/Delhi Cantt are not able to avail the facility of GPRA for the reason that their offices have not been declared "eligible offices" for allotment of GPRA allotted by Directorate of Estates (DoE). The small quota of 15% of residential accommodation of the Defence/Army Pool is grossly inadequate and therefore it causes extreme hardship to the defence civilian employees who have to make their own arrangement for residential accommodation.

2. It has been noticed that Dte of Estates has already granted eligibility for GPRA to majority of defence establishments in Delhi. The defence civilian employees serving in these defence establishments are already availing the facilities of Residential Accommodation of Dte of Estates. Only a few defence establishments are not covered in the list of eligible offices maintained by the Dte of Estates and a list of 8 such defence establishments in Delhi is at Annexure.

3. In view of the hardship being experienced by the Civilian employees of these eight defence establishments, it is requested that eligibility code for allotment of General Pool Residential accommodation (GPRA) to the staff of these defence establishments/offices may please be allotted. It is certified that the essential requirements, listed below, for a Central Government offices to be treated as ‘eligible offices' for the purpose of the allotment of Government Residences (General Pool in Delhi) Rules, 1963, are fulfilled by these offices/defence establishments:
(i) These offices/establishments have been situated in Delhi/New Delhi/Delhi Cantt since decades and in most of the cases before independence.
(ii) They are attached/subordinate offices of Ministry of Defence under Government of India.
(iii) The salary of their employees is paid from the Consolidated Fund of India.
(iv) 15% quota of residential accommodation of the Defence/Army Pool is not adequate.
4. This issues with the approval of Defence Secretary.
